Shawn Brown announced on KENS 5, Friday evening he’s representing two Robb Elementary students who were shot. Shawn is filing the first federal lawsuit in relation to the Uvalde school shooting, determined to prove that law enforcement was negligent in their response on May 24th.
“The shooter was yelling obscene things, he played real weird music, he told them they were all going to die,”
Shawn Brown told KENS 5, who described the absolute terror that took place in Robb Elmentary as it was releayed to him though the family of his 10-year-old client who was shot in the leg and is recovering.
“These poor kids went from the highest of highs – they had an awards ceremony that morning, (it was) their last days of school – and then chaos breaks out,”
Brown said.
Brown said he’s looking into multiple contributing factors that led up to the tragedy that day. He said they will name the City of Uvalde, the school district, and key officers, also including possibly the door lock manufacturer.
Brown also mentioned that he’s looking into the mental health of the 18-year-old shooter.
But the challenging part of this case is if qualified immunity is in play, which shields government officials and law enforcement personnel from being sued. But proving negligence on the part of the law enforcement role that day may overcome qualified immunity, depending on the facts.
