  • Texas followed with House Bill 1325 in 2019, allowing hemp products containing less than 0.3% Delta-9 THC

Retail hemp shops quickly expanded across Texas, including in:

📅 2021

The Texas Department of State Health Services (DSHS) attempted to classify Delta-8 THC as illegal under the Texas Controlled Substances Act. This immediately triggered lawsuits from hemp businesses.


📅 2025

Texas lawmakers and regulators began discussing stronger statewide restrictions targeting:

  • Smokable hemp
  • Vape products
  • THCA flower
  • Hemp-derived THC products

📅 March 31, 2026

Texas implemented sweeping new hemp regulations that:

  • Created a new “Total THC” testing standard
  • Counted THCA toward THC limits
  • Effectively banned many smokable hemp products
  • Increased licensing fees dramatically for hemp businesses

Many stores were forced to remove products from shelves immediately.


📅 April 2026

A Travis County judge temporarily blocked the smokable hemp ban, allowing products to return to stores while lawsuits continued.

Then the state appealed.

Then enforcement shifted again.

Then courts revisited the issue again.

Consumers and businesses struggled to keep up.


📅 May 1, 2026

A Texas judge ruled that smokable hemp products could continue being sold—for now—until at least July while litigation continues.

However, on the SAME DAY:

  • The Texas Supreme Court ruled the state likely has authority to regulate Delta-8 THC as a controlled substance.

So now:
✅ Some smokable hemp products remain on shelves
⚠️ Delta-8 legality remains under legal pressure
⚠️ Enforcement rules continue changing rapidly
